The Fox OFCCP Report: New OFCCP Federal Contract Compliance Manual Has Many Provocative Surprises

Because OFCCP has not yet released the new "Federal Contract Compliance Manual" ("FCCM") to the public even while the agency uses it to train its Compliance Officers, I thought I would devote this column to the new FCCM and report ("verbatim") some of its more provocative content. Because you do not have copies of it, I did not want to summarize it. Rather, I wanted you to see for yourself whether I had faithfully characterized what I am reading. The new FCCM is dated July 2013 and is a streamlined and svelte 486 pages long. The new 2013 FCCM replaces the 730 page 1998 OFCCP FCCM, effective already. read more

New OFCCP Directive on Back Pay

On July 17, 2013, the Office of Federal Contract Compliance Programs (OFCCP) issued a new directive on how to calculate back pay for victims of employment discrimination. The Directive serves at least two purposes. First, it memorializes current practices in the calculation of monetary remedies at OFCCP. Second, it resolves some open questions or variations in the approach to the basic calculation of remedies between the Regions. The Directive is intended to improve consistency in the methods used to calculate back pay. Federal Contractors who have consistently requested more consistency in agency practices from Region to Region should appreciate the issuance of this guidance. read more

How to Set Priorities for an OFCCP Review - Part 2

Several articles in the August 2013 edition of The OFCCP Digest will discuss what was learned from the recent National Industry Liaison Group (NILG) conference that was held in July in Indianapolis. While the conference was useful and interesting, it had very little effect on the basic premise of this two-part series of articles. We suggested in part 1 of this series that companies should pay special attention to situations where OFCCP might find discrimination, and especially those situations involving entry-level hiring where OFCCP has historically been most likely to find discrimination. read more

Fast Facts of the 2013 Annual ILG National Conference

The National Industry Liaison Group (NILG) held its 31st Annual ILG National Conference and Exhibition at the Indianapolis Marriott Downtown in Indianapolis, Indiana from July 30 to August 2, 2013.

The conference showed an increase in attendance with 730 attendees, 42 exhibitors, and 24 sessions while the 2012 conference hosted 428 attendees, 25 exhibitors, and 29 sessions. read more
